The injunction that prohibits the state from collecting sales tax on the sale of cigarettes by Native American Nations in New York State is back on again.

The appellate division of state Supreme Court granted the Seneca Nations request for a temporary restraining order Thursday. The Seneca Tribe is the biggest seller of cigarettes among the state’s Indian Nations.

On Wednesday,  a state Supreme Court judge in Buffalo lifted the long standing injunction when he rejected the western Seneca’s challenge to regulations adopted by state taxing officials. The injunction against collecting taxes is now back in effect while the Senecas appeal that decision. The new order prohibits the collection of the $4.35-per-pack tax on cigarettes until June 20.

There was no immediate comment from Gov. Andrew Cuomo’s administration on the latest delay.

The latest court order also allows the Cayuga Indian Nation of New york and the Seneca-Cayuga Indian Tribe of Oklahoma to continue selling cigarettes at their stores in Seneca Falls and Union Springs.
